Commissioning Agreement

1. I have every right to deny request for commissions without any reasoning. I only take 5 commissions at a time and when I am complete with that 5 list of requests I will accept the next 5. Please check my commission status on my signature and on my profile page before deciding to commission me.

2. I have the right to retain copyrights to the artwork style and labor put into each commission. I do not have the right to claim any OC characters of yours or anyone else's as my own and all rights to OC characters belonging to you or anyone else will remain respectfully yours.

3. I have the right to sign my commissions anywhere visible to show that I am the creator of the commission. Signature will either me a script handwriting on the outlines of the character in image or a phoenix emblem symbol watermarked or embeded to the image. All copyrights of an OC, or already created character are respectfully kept and credit to the proper owners.

4. YOU DO NOT HAVE THE RIGHT to remove my commission copyrights, signature, watermark emblem or any other copyrights to a character that is not yours and is not of your own creation.

5. You have the right to cancel your commission request at anytime. Thought this will mean that if you wish to use my services again it won't be on good terms. I do not like having to work for people that can't be patient with the time that it takes to do a commission. If you can't be patient please do not commission me.

6. I will do all types of art although art that contains erotica, sexual nature or hardcore xxx material will have to go through some extra consenting meaning if you are not of proper age I will not do this art for you. If you don't know what's the proper age to request these art from me then don't request it at all. I don't care where you live you must be of proper age to commission me for these type of request.

7. If you are commissioning me through GaiaOnline and are expecting to pay me in Gaia Gold then you MUST send a trade request first with the subject "ART COMMISSION - Type of art you want (Look at the pricing)" It will sit in trading until I have completed the work and you are satified with it. For Gaia Commission it's 200 Gaia Gold to the dollar. $1 = 200 Gold.

If you are commissioning me with cash you are to pay me via PAYPAL (or credit card via Paypal) the whole amount if it's up to $25. If your commission is $50 or more you are require to pay half the amount or the whole thing. At least pay half to get me started on the commission. I will not start your commission request unless there something is paid on it.

8. I have the right to NOT show you any progress of the work. If you like to know the progress of your commission you can check my Gaia profile for the progress or this website here for the WIP (Link coming soon). I usually have a WIP image that changes whenever I feel the need to let you know that I am currently working on your request. Also a list of 5 people will be under that WIP image and it will tell you if your request is being worked on or in waiting.

9. By commissioning me you give me the right to use the artwork request in any printed material for my promotional use such as an artbook, business cards, etc. If it's a request of your original character it will be credited to you as your original character but artwork by me.

Art Trade Agreement

1. If you request an art trade you will accept the agreement that being it is a "FREE" request it will take a while to be worked on. I DO have the RIGHT to refuse the art trade and cancel the art trade request at anytime I feel necessary.

2. By requesting an art trade with me you UNDERSTAND that this is not a high priority request and it will be shuffled to the bottom of my list. You UNDERSTAND that my first priority is taking care of my family and the PAID COMMISSION request first before I come to the art trade request.

3. I do have the right to not accept any request or instant message from you regarding the art trade matter. I do have the right to be rude if you don't understand that I have more important things to do than do "FREE" artwork for you.

4. By requesting an art trade with me you ACCEPT the fact that I am a mother and a wife and that my life takes first priority. My priority is set like this,

Art trade

Now if you can accept this then you may have an art trade with me. If you can't accept this and want your request done right away you might as well gather some money and ask for a PAID COMMISSION.

5. I will do art trade request of your Original Characters ONLY. Your art trade request will NOT be high quality as it is with paid commission. Your art trade request will be consisted of pencil sketch, hand ink and a quick color. You will NOT get the original sketch or a CD with the images on it. You will only get a low resolution image file of it through email.

Your new terms are incompatible with work done for Anime Mayhem. The absence of commercial use and derivative work permission pretty much makes this route a dead end for me. My existing artists give me these permissions by contract so I'll have to stick with them.

Your insistence to watermark something I would be paying you to do deters me from wanting to hire you for any work. There's other artists with prints available without watermarks or that I can hire for commissions that don't have watermarks on the final piece afterwards.

Signatures I don't mind but watermarks are a sore spot with me becuase they deface the work. It's bad enough it has to be done with the publicly displayed stuff (I understand the sentiment there) but I simply don't find getting a defaced product justifiable as something I'm paying money for (would you pay money to get your car painted if the owner was going to put hand-prints on the final paint job all over the car)?

Well if you're going to be RUDE about it because you seem to put off being just THAT, ff course by "contract" your exisiting artists would give you permission. If it's legal between you and the artist. Also one of the artist you commission is someone that I HOST personally on my server.

I ONLY watermark the finish images that is going to be put ONLINE. This is for the fact that people time and time again have NO respect for artist and their hardwork when their work is put online especially those that download the images and then re-uploads them and claim them as their own in their art portfolio. To those that have commission me they and ask for the print to be mailed to them WILL NOT have the watermark all over the image. If they ask for a CD they will have a MERGED PSD file with a layer of my signature on it that they can turn off along with three size images.

Anyway point being is that if you're going to complain about a commissioning agreement that an artist put up then you probably have no respect for their work. I have time and time again seen artist being asked for commission and then get ripped off by the people who commissioned them. As well I have been once been hired for work and then got ripped off from my hardwork. There are image thieves out there and though my commission agreement sounds harsh it just states that "I HAVE THE RIGHT TO" do the stuff that I the artist want to do. My commissioned pisces I only put a tiny emblem somewhere visible and where it will be difficult to edit, or won't put any at all and just put a text copyright. As for your "absence of commercial use and derivative work permission pretty much makes this route a dead end for me" I'm pretty sure you want to commission someone for your "Original Characters" for your RPG, in which I have no power over of it's content and description because it is YOUR characters.
